Registration payment is due in full at time of registration. Obesity Medicine Association (OMA) will not be required to provide any services until OMA has been paid in full. Attendees must be 18 years or older. Persons under the age of 18 are not allowed to register nor accompany registered attendees to event functions.
Event Cancellation by OMA
OMA reserves the right to cancel an event due to (1) low enrollment, (2) failure, delay, disruption or malfunction of the internet or any communication network, utility or communications failures or outages (including electrical, telecommunications, or internet service) or failure or delay in receiving electronic data; (3) equipment error, human error or data entry errors, or (4) earthquake, flood, tsunami/tidal wave, lightning, hurricane, tornado, blizzard, or other acts of God; labor disputes, strikes, shortages of materials, rationing; war, acts of terrorism, revolution, civil commotion, acts of public enemies, blockade, embargo, or any law, order, proclamation, regulation, ordinance, demand, or requirement having legal effect of any regulatory authority or other competent governmental or judicial body, agency, or authority; pandemic or infectious disease; or other circumstances which would make the event non-viable, impossible, inadvisable, illegal or commercially impracticable, as determined in OMA’s sole discretion. If OMA cancels an event, attendees will be offered a refund. Should circumstances arise that result in the postponement of an event, OMA has the right to either issue a refund or transfer registration to the same event at the new, future date. OMA will not be responsible for reimbursement of any participant’s expenses related to the cancellation or postponement of an event.
Registration Cancellation Policy
OMA will be offering in-person and virtual options for attendees. Attendees can transfer at no charge from in-person registration to virtual registration for Obesity Medicine 2021 and the difference between the two registration costs will be refunded to attendees. If the in-person conference for Obesity Medicine 2021 is cancelled due to COVID-19, all registrations will be converted to virtual registration and the difference will be refunded. Written notice of cancellation is required if attendee decides to terminate virtual registration.
Attendee Cancellation Fee
A $100 cancellation fee is deducted for any cancellations received prior to April 7, 2021. Refunds are not granted for cancellations received after April 7, 2021, or for no-shows. If a ‘registration + first-time membership’ bundle is purchased for in-person or virtual, only the registration portion of attendee’s payment is refundable. Registration is non-transferable.
Should OMA offer to provide a refund under the terms of this Agreement for any reason, OMA may retain such part of the registration fees as shall be required to recompense OMA for its expenses and obligations related to the event.
Consent to the Use of Photographic Images
Registration and attendance at or participation in OMA-sponsored events/activities constitutes an agreement by the attendee for OMA’s use and distribution of the attendee’s image or voice in photographs, video, electronic reproductions, and audio recordings of such events/activities.
Attendee Code of Conduct
Obesity Medicine Association (OMA) reserves the right to remove an individual from the conference at its sole discretion (including without warning or refund) if it is determined that participation or behavior create a disruption or hinder the event. Disruptive behavior includes, but is not limited to, behavior or comments that are defamatory, abusive, threatening, harassing, discriminatory or that in any way fail to comply with these guidelines. Attendee shall pay all expenses and damages that OMA may incur thereby.
OMA seeks to avoid antitrust violations in connection with its activities, so participants should avoid engaging in conduct that gives even the appearance of an impermissible conversation, agreement, alliance, or impropriety. Discussions among attendees, speakers, exhibitors, board members, and staff must be kept free of even suggestion of restraint of trade or the selection of suppliers, customers, or prices.
Liability Waiver & Release
In consideration of being allowed to register for, and participate in, an event, activity, or experience (“Event”), attendee hereby waives, releases from liability, assumes all risks, and covenants not to sue Obesity Medicine Association (“OMA”), or their respective members, employees, board members, agents, or volunteers (“OMA Parties”) for any expense, loss, damage, personal injury (including loss of life, disability, or serious harm), property damage or theft, negligence, or actions (each, a “Loss”) resulting from or arising in connection with attendee’s travel to, attendance at, or participation in the Event and any related activities. Attendee agrees that this waiver and release shall bind attendee and attendee’s personal representatives, shall be enforceable to the fullest and broadest extent of the law, and, if any portion is held invalid, the remainder should continue in full legal force and effect. Attendee is an adult of sound mind and capable of entering into this waiver. Attendee has read its terms and fully understands and agrees to the provisions herein.
Attendee understands and is aware that attendee’s participation in Obesity Medicine 2021 involves risk, including, but not limited to, travel, physical activity, locales where public health and safety may be at risk, or activities that involve risk that attendee create for others or others may create for attendee. These risks may lead to a Loss, and attendee nonetheless chooses to participate in Obesity Medicine 2021. Attendee is also aware that there are risks that attendee may not have considered, yet attendee waives attendee’s right to any claims that may occur from these unconsidered risks and attendee chooses to participate in Obesity Medicine 2021. Attendee acknowledges that no promises, representations, or affirmations of fact were made to attendee by OMA or its representatives concerning the safety or danger associated with traveling to Obesity Medicine 2021or participating in any activity or interaction related to or associated with Obesity Medicine 2021.
Liability Disclaimer and Release: COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic. COVID-19 is reported to be extremely contagious. The exact methods of spread and contraction are unknown, but the virus is believed to spread from person-to-person, by contact with contaminated objects, and even possibly in the air. People reportedly can be infected and show no symptoms yet still spread the disease. COVID-19 is reported to cause serious illness and death. OMA cannot prevent attendee from becoming exposed to, contracting, or spreading COVID-19 while at the Obesity Medicine 2021 premises, at an OMA event or activity, or performing any action for or on behalf of OMA or its representatives. Any in-person interaction with, at, or for OMA may increase the risk of contracting or spreading COVID-19.
Attendee agrees and understands these specific risks and nonetheless accept them in order to utilize OMA’s services and attend Obesity Medicine 2021. These services are of such value to attendee that attendee accepts the risk of being exposed to, contracting, and/or spreading COVID-19 in order to participate in person rather than arranging for an alternative method participating or not participating at all. Attendee further hereby forever releases and waives all claims and rights against the OMA Parties in connection with exposure, infection, and/or spread of COVID-19 related to utilizing their services or premises or interacting with OMA’s members. Attendee understands that this release and waiver means attendee gives up attendee’s right to bring any claims including for personal injuries, death, disease, property losses, or any other loss that may be released and waived under applicable law, including, but not limited to, claims of negligence, and attendee understands that this release and waiver prevents attendee from seeking damages in any way against the OMA Parties, whether such damages are known or unknown, foreseen or unforeseen, or that occur now or in the future.
Limitation of Liability
The liability of OMA shall be limited by the terms and conditions appearing in this agreement. IN NO EVENT SHALL OMA BE LIABLE UNDER THIS AGREEMENT FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, AND/OR CONSEQUENTIAL DAMAGES, EVEN IF THE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The maximum extent of OMA’s liability shall be the amount of the registration fee paid by attendee.
Intellectual Property Rights
OMA reserves all title and all other rights in or to the presentations, materials, and any related documentation (including all Intellectual Property Rights) provided during Obesity Medicine 2021 (“Intellectual Property Rights”). Nothing contained in this Agreement will (directly or indirectly) be construed to assign or grant attendee any right, title, or interest in and to the Intellectual Property Rights except as may specifically provided by in writing by OMA.
Attendee agrees to indemnify, defend and hold the OMA Parties harmless from and against any and all claims for damages, injuries, losses, liabilities and expenses relating to, resulting from or arising out of attendee’s attendance at or participation in Obesity Medicine 2021.
These terms and conditions, including, without limitation, all waivers and releases herein, shall be construed broadly. If any part of any provision of these terms and conditions, including, without limitation, the waivers and releases herein, shall be invalid or unenforceable under applicable law, said part shall be ineffective to the extent of such invalidity or unenforceability only, without in any way affecting the remaining parts of said provision or the remaining provisions of these terms and conditions.
These terms and conditions shall be construed in accordance with the laws of the State of Colorado without reference to or application of its rules governing conflicts of law. In addition, all disputes arising under this Agreement shall be resolved in any state or federal court in the State of Colorado that properly has subject matter jurisdiction and venue with respect to such a lawsuit, and attendee agrees, solely for purposes of this Agreement, to submit to the personal jurisdiction of that court.
In accordance with OMA policy, commercial companies may apply to advertise in OMA publications. Approval does not imply OMA’s endorsement or official recognition of particular products or services.
